Beginning January 11, 2024, Canada has joined the Hague Apostille Convention. This simplifies authentication services, as documents issued for use in other member countries no longer require legalization. More than 120 countries are involved, and any document issued by the Canadian Government or a notarized document verified by a Canadian authority will receive an authenticity certificate known as an apostille, which is affixed by a designated competent authority and confirms their legitimacy for international use.

    What Factors May Disqualify a Document from Receiving an Apostille Certificate?

    Only documents with an original signature or seal qualify for the authentication process. Photocopies and documents that lack these features are not accepted. Documents containing glue or lamination cannot be stamped because they prevent appropriate processing. Any protective layer that interferes with stamping makes the document ineligible for apostille. If the seal or signature on a document cannot be verified, Global Affairs Canada cannot proceed with the authentication.

    Documents from religious institutions, such as baptismal or marriage certificates, are not eligible for apostille.

    The Canadian Department of Foreign Affairs only recognizes documents generated within the country; foreign-issued documents are not accepted. 

    If required, Global Affairs Canada could report the issue to the appropriate authorities and refuse to affix an apostille to documents that are misleading or used for illegal or fraudulent reasons. 

    Is Document Notarization Required Before Applying for an Apostille Certificate?

    Certain documents issued by the Government of Canada or other government agencies may be required to be notarized in their relevant province or territory by a Canadian notary public before the competent authority can authenticate them. The country where your document is notarized will dictate which authority you should submit it to for processing.

    Notarizing particular copies of documents can also expedite the time needed to secure an apostille, facilitating quicker processing. The Legalization Service Centre (LSC) works alongside official notaries in multiple provinces, offering thorough assistance for clients requiring authentication services.

    Should the Document Need To be Translated Before Getting an Apostille?

    If any portion or all of your document is written in a language other than English or French, it may require a certified translation from a certified translator who is a member of a recognized provincial translators’ association.

    Alternatively, you can utilize a Canadian notary who is fluent in English or French, and the original language of the document. In this situation, the notary must include a special certification endorsement to confirm that the document is authentic.

    The most effective approach for verifying documents in foreign languages is decided on a case-by-case basis.     How Much Time Does Saskatoon's Apostille Process Take?

    As of late September 2024, the authentication section at Global Affairs Canada generally processes apostille requests in about 10 business days. Furthermore, kindly permit an additional 5 business days for the return shipment of your documents.

    As of January 11, 2024, provincial competent authorities, including those in Saskatoon, have been granted the authority to legalize documents. However, the processing times with these provincial authentication authorities may differ depending on the organization.

    What Other Factors Should You Consider When Obtaining an Apostille?

    The cost of apostilling documents varies based on the type of document and its place of issuance. For the most current fee information or to acquire a request form, please contact our specialists at the Legalization Service Centre (LSC).

    Does an Apostille Confirm the Content of the Document? An apostille does not evaluate or confirm the information contained in the document. Instead, it verifies the signer’s authority and the issuing organization’s validity.

    An apostille is required solely for nations that are part of signatories of the Hague Apostille Convention. Documents from non-member countries still need to undergo the authentication or legalization process.

    In Canada, provinces such as Alberta, British Columbia, Ontario, Quebec, and Saskatchewan have designated competent authorities authorized to issue apostilles for documents originating within their jurisdictions.

    An apostille does not have an expiration date; however, the legal validity of the certificate and the documents it accompanies may differ depending on the destination country’s laws. Therefore, verifying the specific requirements for the documents needed in the location where they will be utilized is essential.
