Apostille in Victoria and Amendments to Whole Canada Document Authentication

Before using Canadian or foreign public records abroad, they sometimes need authentication and legalization to confirm the validity of the official’s signature on the document. Imagine that the nation where your paper is utilized does not follow the Hague Convention. In such a situation, you might have to have it approved by the embassy or consulate or high commission accredited in Canada of the country of travel. But imagine your public document has been authenticated using an apostille certificate for usage in a nation party to the Apostille Convention. In such a situation, it is usually accepted without further legal action.

The Hague Apostille Convention became effective for Canada on January 11, 2024, to simplify document authentication methods while eliminating the traditional requirement for document legalization between convention members. Documents issued in Canada or notarized by an accredited notary public can now get an apostille certificate, which takes the shape of an allonge safely affixed to the primary document, authenticated by a Canadian body.

Canada formally joined the Hague Convention to be a member of the Hague Apostille system as of January 11, 2024. Without more legislative action, this shift lets Canadian public documents be attested with an apostille accepted by all convention members. This simplified approach greatly lessens the difficulty of authenticating and licensing Canadian materials for usage elsewhere. Frequently Asked Questions

What Can Prevent a Canadian Document from Being Eligible for Authentication Under the Hague Apostille Convention?

Documents must be issued with an original signature or seal to be considered eligible; photocopies or those without these features are not eligible. If the seal or signature on your document cannot be verified, authentication at Global Affairs Canada cannot continue. Documents with glued or laminated surfaces are not eligible for stamping or authentication. Any coating that prevents stamping makes a document ineligible for apostille.

Documents like baptismal certificates or those provided by religious institutions do not qualify for an apostille.

Only documents issued in Canada are eligible for authentication; thus, foreign documents will not be accepted. If the document is issued by an institution not officially recognized, it cannot be eligible for an apostille certificate.

Suppose Global Affairs Canada has concerns that the document authentication could be misleading, potentially fraudulent, or in breach of policies. In that case, they may deny the apostille request and escalate the issue to the relevant authority.

Do Public Documents Need to Be Notarized Before Authentication and Apostille?

Certain public documents require notarization by a notary public before being authenticated by a competent authority, which includes certain documents issued by the Government of Canada. The province or territory where your document is notarized will dictate the correct jurisdiction to apostille your documents.

Notarizing particular copies can also greatly speed up acquiring an apostille. The Legalization Service Centre (LSC) works alongside official notaries in various provinces, including those addressing Victoria, British Columbia, apostille requirements, and is prepared to support this vital process, facilitating a more seamless journey to authentication and legalization for international purposes.

Should the Document Need To be Translated Before Getting an Apostille?

Suppose any section of your document is in a language other than English or French. In that case, you must provide an official translation by a certified translator member of a recognized provincial translators’ association for authentication or legalization.

You may also collaborate with a Canadian notary fluent in English and/or French, as well as the document’s original language. In this situation, the notary must include a special certification endorsement to confirm that the document complies with the criteria for an apostille.

The appropriate verification method for documents in different languages is assessed individually for each situation. The Legalization Service Centre (LSC) is equipped to assist with obtaining an apostille for one or more documents, guiding our clients through the apostille section of the Hague and ensuring compliance with international requirements.

How Long Does the Apostille Process Take in Victoria?

As of late September 2024, the verification program at Global Affairs Canada usually handles apostille requests in 10 business days. It takes five business days for the documents to be shipped back.

The Apostille Convention went into effect on January 11, 2024. Since then, provincial competent authorities like the Ministry of Attorney General of Victoria, British Columbia, can also legalize documents. However, the time it takes to do so may vary based on the authority.

We at the Legalization Service Center (LSC) know how important it is to handle apostille requests quickly. We use our knowledge and relationships to speed up the process as much as possible. Getting an apostille has a record-setting turnaround time of just one business day.

What Other Factors Should You Consider When Obtaining an Apostille?

The costs associated with apostille services depend on the specific document and where it was issued. For the latest fee information or to obtain a request form, kindly reach out to our specialists at the Legalization Service Centre (LSC).

Does an Apostille Confirm the Content of the Document? An apostille does not evaluate the content of a document; it merely verifies the authority of the signer and the validity of the issuing organization.

An apostille is required solely for nations that are part of the Hague Apostille Convention. Countries that are not members still need to follow the conventional authentication and legalization procedures.

In Canada, provinces, including Alberta, British Columbia, Ontario, Quebec, and Saskatchewan, are recognized as competent authorities authorized to issue apostilles under the Apostille Convention.

Although an apostille does not have an expiration date, the legal validity of the certified document may vary based on the regulations of the destination country. Therefore, verifying the requirements for the intended use of your document is crucial.
