What Amendments to Authentication Services Does the Apostille Convention Provide for Canadian Documents?

 

Since Canada joined the Hague Apostille Convention on January 11, 2024, public documents from Canada that are going to the Netherlands only need an apostille from Global Affairs Canada or a provincial authority. The Dutch Embassy in Canada or consulates do not need to legalize these documents again after they have been apostilled. They are recognized directly by the Dutch Government.

The Apostille Convention, however, does not apply to documents issued by Dutch diplomatic or consular officials. This means that consular certificates (such as a certificate of life or certificate of residence) issued by the Netherlands Embassy Ottawa or Consulates remain outside the apostille framework. The Embassy of the Netherlands in Ottawa, along with the honorary consulate general, continues to provide consular services for Dutch nationals living in Canada, including applications for Dutch passports or ID cards, visas (Schengen, MVV, and Caribbean), emergency travel documents, and official certificates. These services from the Dutch government fall under the responsibility of the Ministry of Foreign Affairs of the Netherlands, ensuring Dutch citizens abroad receive the same level of support as those at home.

    On January 11, 2024, Canada joined the Hague Apostille Convention. This will make it easier to get Canadian documents certified for use in other countries. With an apostille certificate, documents issued and validated in Canada are now accepted in all countries that are part of the convention, including the Netherlands. This means they no longer need to go through any additional steps to be legalized.

    Why Might a Canadian Document Not Qualify for Apostille for Use in the Dutch Government?

    Only documents with the original signature or seal can be authenticated. Apostilles cannot be provided for photocopies or documents that do not match the above conditions. If the document’s seal or signature cannot be authenticated, Global Affairs Canada will not continue with the authentication process.

    Documents with laminated or glued surfaces cannot be stamped or apostilled. Documents that contain substances that prevent stamping cannot be apostilled.

    Certificates issued by religious institutions, such as baptismal or marriage certificates, are not eligible for official document services or apostille verification. Only Canadian-issued documents are accepted. Foreign documents cannot be authenticated or apostilled. An apostille with a certificate number cannot be granted for documents from non-formally recognized organizations.

    If Global Affairs Canada believes a document will be used fraudulently or violates policies, it may refuse to validate an apostille and refer the case to the authorities.
